Defendant Case No. 99-7430-CI- TEMPORARY INJUNCTION FOR PROTECTION AGAINST HARASSMENT AND VIOLENCE THIS CAUSE, coming before the Court upon the Petition for Injunction for Protection Against Harassment and Violence filed by the above-named Petitioner, with an ex-parte request for a Temporary Injunction pending full hearing, and it appearing to the Court that an immediate and present danger of harassment and violence exists, pending a full hearing, and that giving notice to the Respondent of the application for a temporary injunction would accelerate the wrong and injury apprehended by said Petitioner, staff members and the parishioners of the Church of Scientology Flag Service Organization and its facilities immediate and irreparable injury, it is hereby Ordered and Ajudged: 1. An immediate Injunction is entered against the Respondent, enjoining him from committing any acts of harassment or violence against the Petitioner, any staff member or parishioner of the Church of Scientology Flag Service Organization or its facilities in Pinellas County. 2. Respondent is ordered to stay away from the Peitioner, staff members and parishioners of the Church of Scientology Flag Service Organization. 3. Respondent shall stay at least 150 yards away from the following locations which are owned or leased by the Church of Scientology Flag Service Organization: a. Fort Harrison Hotel, 210 South Ft. Harrison Avenue, Clearwater, Florida; b. Sandcastle Building, 200 North Osceola Avenue, Clearwater, Florida; c. West Coast Building, 118 North Ft. Harrison Avenue, Clearwater Florida; d. Coachman Building, 500 Cleveland Street, Clearwater, Florida; e. Clearwater Bank Building, 503 Cleveland Street, Clearwater, Florida; f. Hacienda Gardens, 551 Saturn Avenue, Clearwater, Florida; g. Yatchsman, 1024 Cleveland Street, Clearwater, Florida; h. Quality Inn, 16432 U.S. Hightway 19 North, Clearwater, Florida; i. Mariner Hotel, 711 Celeland Street, Clearwater, Florida; j. Bayside Student Motels, 1840 North Ft. Harrison Avenue, Clearwater, Florida; k. Clipper Student Motel, 1850 North Ft. Harrison Avenue, Clearwater, Florida; l. Tradewinds Student Motel, 1824 North Ft. Harrison Avenue, Clearwater, Florida; m. Osceola Inn, 211 N. Osceola, Clearwater, Florida; n. Burnside Building 309 Garden Street, Clearwater, Florida; o. Auxillary Building, 109 North Ft. Harrison, Clearwater, Florida; p. Student College, 531 Franklin Street, Clearwater, Florida; q. Site of the former Graymoss Hotel in downtown Clearwater, Ft. Harrison to the West, Pierce Street to the North, Garden Street to the East and Franklin Street to the South. Any violation hereof shall constitute contempt of Court punishable by fine or imprisonment. This Temporary Injunction shall be effective from this date until a hearing by this Court. Because this Temporary Injunction Prohibiting Harassment and Violence has been issued without notice to the Respondent, the Respondent is hereby advised that he may appear and testify at a hearing to be held on the 15th day of November 1999 at 12:00 o'clock pm in the chambers of Judge Thomas E. Penick, Jr. Circuit Court Judge, at the Pinellas county Courthouse, 545 1st Ave. St. Petersburg, Florida at which time the Court will consider whether this Temporary Injunction Prohibiting Harassment and Violence shall continue for a longer period and whether further relief should be granted. If the Respondent does not appear, this Injunction may be continued in force and further relief granted. In the event Petitioner fails to appear at the above-scheduled hearing this cause shall be dismissed. This injunction is valid and enforceable in all counties in all counties of the State of Florida. Any sworn law enforcement officer may assist in the execution or service of this injunction. IT IS FURTHER ORDERED that Petitioner shall post a bond in the amount of $1,000.
