Baird final judgement against Minton

FINAL JUDGMENT	

THE ABOVE CAUSE came on for hearing on December 6, 2001, on the court's order
of October 5, 2001, finding that plaintiff is entitled to recover its reasonable
legal fees and expenses in connection with the subject matter of the motion
to compel deposition, and that said recovery would run against Robert Minton.
The court has considered the unrebutted testimony of plaintiffs witness,
Stephen O. Cole, and the affidavits of Samuel Rosen filed August 31 and October
16, 2001, and has concluded that a reasonable hourly rate for legal services
rendered in this matter by attorney Rosen is $ 300 and the court finds that
the out-of pocket expenses itemized in Mr. Rosen's affidavits are
reasonable. The court has also considered the recent opinion in Eve's Garden,
Inc. v.

 
Upshaw, 26 FI.L.Wk, D2119a (2d DCA Fla. 2001) and being otherwise fully
advised in the premises, it is hereby 

ORDERED that

1.	Judgment is hereby entered in the amount of $14,850 for
49.5 hours of Mr. Rosen's time; $4,433.75 for out-of-pocket
expenses;
and $ l 125  for 4.5 hours of Mr. Cole's time at $250 an hour.	

2.	The total amount awarded is $20,408.75, for which
sum let execution issue.

3.	The liability imposed herein is against Robert Minton, 33 North
Ft. Harrison, Clearwater, FL 33756, and 137 Fremont Road, Sandown
New Hampshire 03873.

DONE AND ORDERED in Chambers at Clearwater, Pinellas
