To be a bit more legal, they deny his request to prohibit Schaeffer
from hearing the wrongful death case "with prejudice," meaning he
can not bring it again.  They further state that since the counterclaim
is not going anywhere until after the wrongful death case, that he 
can't do anything about that case either.
