Two members of the Church of Scientology, assessed thousands of dollars in attorneys fees by the United States District Court for the Northern District of Illinois, have withdrawn appeals in a lawsuit won by the Cult Awareness Network last year. CAN originally sued Scientologists Valen Cross and Samuel Demeter in 1992 for using the CAN name and service mark without authorization. Both Cross and Demeter had attempted to form CAN affiliates in San Francisco and Portland, Ore., respectively, without authorization from the Cult Awareness Network. The two ignored demands by CAN that they stop using the CAN name and service mark. In October of last year both defendants stipulated to a judgement against them for their wrongful conduct, and CAN was awarded over $28,000 in attorney's fees. Cross and Demeter then appealed the order to the United States Court of Appeals for the Seventh Circuit. Chicago attorneys for the plaintiffs, John Moran and Clarence Wilson, then withdrew from the case, and early this month Demeter and Cross, representing themselves "pro se," each filed a Motion for Voluntary Dismissal, which the court granted, effectively dismissing the appeal. CAN will now move forward in executing the judgment to collect the award for the thousands of dollars in attorney's fees expended in protecting its name. CAN was represented by Gregory J.
