Rosedale, President of the American Family Foundation (AFF, publisher of the Cult Observer) brought by the law firm of Bowles & Moxon, described in an article in the American Lawyer of July/August, 1992, as the Church of ScientologyÕs Òde facto in-house [legal] department.Ó Bowles & Moxon wrote to the Disciplinary Committee complaining of RosedaleÕs activities while representing an individual in an action which did not, according to Rosedale, Òin any way, shape or form involve the Church of Scientology or Bowles & Moxon.Ó The complaint stated that Bowles & Moxon retained a New York private investigator to look into Rosedale following alleged, but unspecified, conduct toward the public, the medical profession, the courts, and fellow bar members. The complaint, Rosedale says, falsely claimed that in certain court proceedings he had been Òless than forthrightÓ in one instance and allowed some unspecified personal concerns about peopleÕs constitutional rights to interfere with his obligations as a lawyer. Rosedale interprets the unclear language of the complaint to imply that his role as a cult critic and president of the American Family Foundation (publisher of The Cult Observer) should preclude his representation of cult victims, a view, he adds, which has no legal merit. The bar committee immediately recognized the frivolous nature of the complaint, Rosedale reports, and dismissed it without even requiring a response from him. The AFF president asserted that the com-plaint reveals the continued proclivity of the Church of Scientology and its counsel to distort facts and make allegations without regard to the truth. The allegations, he added, contain an incomplete and inaccurate description of the court proceedings in question, and do not describe their outcome, which was a complete, unqualified vindication of the actions of a client in firing her cult-connected attorney and repudiating his efforts to lure her back to the group and to harass her parents. While Rosedale is gratified that the committee rejected the complaint out of hand, Òit is troubling to note,Ó he adds, Òthe continued efforts by the Church of Scientology to harass its opponents through retention of private detectives and filing of baseless complaints with professional ethics committees. It would be more appropriate if those committees looked into the course of conduct of the complainants and exercised their oversight to bring the professional zealots to account.Ó (Cult Observer Report, 7/8/92) ================================================================= If this is a copyrighted work, you are acknowledging by receipt of this document from FACTNet that on the basis of reasonable investigation, you have not been to obtain a copy elsewhere at a fair price, and that you are and will abide by the following copyright warning.
